The hourly rate for the Criminal Justice Act (CJA) panel attorney has been increased from $132 to $140 for work performed on non-capital cases on or after March 23, 2018. Where the appointment of counsel occurred before March 23, 2018, the new compensation rates will apply to the portion of services provided on or after March 23, 2018.
Likewise, the panel attorney case compensation maximum amounts, excluding expenses, have increased from$10,300, $7,300, and $2,200 to $10,900, $7,800, and $2,300 respectively, in the following types of matters: felonies, proceedings under 18 U.S.C. § 983, post-conviction proceedings under 28 U.S.C. §§ 2241, 2254, or 2255, proceedings under 28 U.S.C. § 1875, proceedings under 18 U.S.C. § 4106A and other representation required or authorized by the CJA (including, but not limited to probation, supervised release hearing, material witness, grand jury witness) and appeals of other representation. Additionally, the other case maximum amount of $2,900 for misdemeanors and proceedings under 18 U.S.C. § 4107 or § 4108, has increased to $3,100.
The new case compensation maximums apply to a voucher submitted by appointed counsel if that person furnished any CJA-compensable work on or after March 23, 2018. The former case compensation maximums apply to voucher submitted by appointed counsel if that person's CJA-compensable work on the representation was completed before March 23, 2018.
